Welcome to Ejom. These Terms of Service ("Terms") govern your access to and use of ejom.app, operated by Ejom Technologies Limited (collectively with Ejom Technologies LLC, "Ejom", "we", "us").
By using our services, you agree to these Terms. If you do not agree, do not use our services.
1. Eligibility
You must be at least 18 years old to use Ejom. By using our services, you represent that you meet this requirement and have the legal capacity to enter binding contracts.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of unauthorized access. We are not liable for losses resulting from unauthorized account use.
3. The Marketplace
Ejom is a marketplace connecting buyers with independent African vendors. Ejom is not the seller of vendor products. The contract of sale is between the buyer and the vendor.
Ejom facilitates transactions, provides payment processing, coordinates shipping from vendors to buyers, and provides customer support. We do not manufacture, store, or inspect vendor inventory except when acting as a fulfillment partner.
4. Buyer Obligations
- Provide accurate shipping and payment information
- Pay for all items you order at the listed price
- Review order details before purchase
- Accept delivery at the address provided
- Not attempt to defraud vendors or other users
5. Vendor Obligations
Vendors agree to separate Seller Guidelines. Key obligations include accurately describing products, shipping items in the condition represented, responding to customer inquiries promptly, and complying with all applicable laws.
6. Orders and Payments
Prices are displayed in USD at checkout. Payment is processed securely by Stripe. Ejom does not store payment card details.
When you place an order, you are making a binding offer to purchase. The contract is formed when we send you the order confirmation email. We reserve the right to cancel orders at our discretion, for example if a product is out of stock, the price was listed incorrectly, or we suspect fraud.
7. Shipping
Shipping times and costs are displayed at checkout. See our Shipping Information page for details. Ejom is not responsible for delays caused by customs, weather, carrier failures, or incorrect addresses provided by the buyer.
8. Returns and Refunds
See our Returns & Refunds Policy. Buyers may request a return within 14 days of delivery for most items. Buyer pays return shipping unless the item is defective or incorrectly described.
9. Commissions and Fees
Ejom charges vendors a commission or monthly subscription fee as outlined in the Seller Guidelines. Buyers pay the listed product price plus any applicable shipping fees. There are no hidden fees for buyers.
10. Intellectual Property
All content on Ejom — including the Ejom name, logo, design, and software — is owned by Ejom Technologies and protected by international copyright and trademark laws. You may not reproduce, modify, distribute, or create derivative works without our written permission.
Vendors retain ownership of their product images and descriptions but grant Ejom a worldwide, royalty-free license to display, reproduce, and distribute this content on the marketplace.
11. Prohibited Conduct
You agree not to:
- Use Ejom for any illegal purpose
- List or purchase counterfeit, stolen, or illegal goods
- Harass, threaten, or defraud other users
- Manipulate reviews or ratings
- Attempt to access data or accounts you don't own
- Use bots, scrapers, or automated tools without permission
- Violate any applicable law
12. Account Termination
We may suspend or terminate accounts that violate these Terms, with or without notice. You may close your account at any time by contacting us.
13. Disclaimers
EJOM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. PRODUCTS PURCHASED ARE SUBJECT TO VENDOR REPRESENTATIONS — EJOM DOES NOT WARRANT PRODUCT QUALITY, FITNESS, OR MERCHANTABILITY BEYOND WHAT APPLICABLE LAW REQUIRES.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EJOM'S TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
15. Indemnification
You agree to indemnify and hold harmless Ejom, its affiliates, officers, and employees from any claims arising from your use of the service, your violation of these Terms, or your violation of any rights of another party.
16. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Ghana. Any dispute not resolved informally will be submitted to the exclusive jurisdiction of the courts of Accra, Ghana.
17. Changes to These Terms
We may update these Terms at any time. Material changes will be announced via email or on our website. Continued use after changes means you accept the updated Terms.
